The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

You and Basement Lighting Company, LLC each waive the right to a trial by jury and the right to participate in a class action, class arbitration, or representative proceeding of any kind. All claims must be brought in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights.

7. Class Action Waiver

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND BASEMENT LIGHTING COMPANY, LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. Unless both you and Basement Lighting Company, LLC agree otherwise, the arbitrator may not consolidate more than one person's claims and may not preside over any form of a representative or class proceeding.
